




Population Census Act of Afghanistan
Section -I
General Provisions
Bases
Article One:
This act is based on Article (25) of Statistical law of Islamic Republic of Afghanistan in order to organize the duties and responsibilities of employees and other government staff, institutions and legal persons that take part in the Population census pregame .
Census Task
Article Two:
Population census, as complete and as sample is the duties of Central statistics office.
Census Activities
Article three:
(1) Population census includes all activities related to collection, classification, evaluation , analysis , tabulation, printing and dissemination of demographical , economical and social data relevant to the population of the country or a region which is conducted in a specific time/period in order to use at all activities such as economical, social and planning for implementation of pubic administrative activities , scientific and demographic research and international comparison .
(2) Information collected during the population census related to personal and household records is confidential and must be kept secret .other general and common matters aimed to accomplish the targets mentioned in paragraph (1) of this article will be published and make them available to the relevant institutions.
Census Time
Article four:
Actual Population census will be conducted throughout the country after every 10 years according the order of Article (15) of the Statistical law.
Population census programme is implemented based on scientific methods suitable for the conditions prevalent in the country in order to design the methodologies for recording of the data related to the population census.
Section -II
Structure, Duties and Authorities
Structure
Article five :
(1) For successful execution and disciplined operation of complete population census ,in addition to Central and Provincial offices , temporary field operation organizations will set up at the level of Districts .(Woluswali) .
(2) The Number of temporary population census offices in the districts (Woluswali) will be determined on the basis of such factors as geographical area, topographical conditions and the density of population in the concerned provinces.
General President of central statistics office will have the final authority in the matter to decide about the number of these offices in the districts.
National Census Committee
Article six:
National Population Census Committee will be established for the successful implementation of the population census utmost two years prior to the conduct of population census by the propose of central statistics office and endorsement of National Statistic Committee and approval of the Islamic Republic of Afghanistan' president .
General President of Central Statistics Office will act as Secretary of the National Population census committee.
Chief of the Census Programme
Article Seven:
General president of Central Statistics Office is the general head of the population census programme as well president of Censuses and surveys department will act as a deputy head of the population census programme .
National Census Committee Duties:
Article Eight:
National Census Committee will have the following duties and responsibilities:
1- Specifying of the Government policy for different stages of the population Census and determining the date and period for conduct of the complete population census.
2-Formulation , preparation and approval of the work programme of the complete population census.
3- Arranging of the structure, budget and various expenditures of the complete population census.
4- Taking necessary decisions for ensuring co-ordination and co-operation among various Ministries , governmental organizations, institutions and municipalities for providing offices , Vehicles, equipment and required personnel for the population census .
5- Consideration of complains and protests addressed to the population census.
Capital and Provincial Co-ordinating Committees
Article Nine :
For the successful execution of population census and the ensuring of co-ordination and co-operation of the concerned Ministries and institutions especially for the fulfillment of the purpose mentioned in paragraph (4) of article eight of the act , Capital and Provincial co-ordinating committees will be set up .
1- Capital co-ordinating committee of the population census is consist of the following:
- General President of Central Statistics Office will be the president of Co-Ordinating committee.
- The authorized representatives of the Ministries and governmental institutions after distinguishing of the National Population Census Committee will be the members .
- Censuses and Surveys president will be the Secretary of the Co-ordinating committee.
He will also organize the capital Co-ordinating committee of Kabul province population census as well .
2- Provincial Co-Ordinating Committee of population census is consist of the following :
- Province Governor will be the president .
- The authorized representatives of the Ministries and governmental institutions mentioned in part (2) of paragraph (1) of this article are the members .
-Head of Central Statistics Office will be the Secretary .
Other Organization cooperation and assistance
Article Ten:
Government Ministries ,institutions, and municipalities in both capital and provinces are responsible to assist with Central statistics office base on the decision of National Census Committee for accurate conduct of the population census.
Section -III
Miscellaneous Orders
Penalty Provisions
Article Eleven:
(1) The staff of the Central Statistics Office and other persons who will be assigned for the conduct of population census are bound to follow and implement all directions and instructions aimed for the successful execution of the census programme which is taught to them with out any bias . And keep the received information confidential.
(2) if the staff of the Central Statistics Office and other persons who are assigned for population census programme found negligence in the fulfillment of their duties and responsibilities shall be punished according the penalty law orders .
Observance of Confidentially
Article Twelve:
The personnel of Central Statistics Office, and other persons who are assigned for execution of population census programme are bound to preserve the secrecy of statistical data collected by them , if statistical information is disclosed or misused for the personal benefits and /or for other purpose and if the data are intentionally altered or forged . Persons committing such unlawful acts shall be punished and followed by justice investigation.
Citizens Responsibility
Article Thirteen:
(1) All the citizens of Afghanistan are bound to provide exact and accurate response/information to the written or oral questions of the census enumerators.
(2) Persons who are found guilty of furnishing intentionally wrong information to the questions of the enumerators, will be followed by the justice investigations according to the law orders.
Deterrence of Census programme
Article fourteen:
Any person found guilty of disturbing the Census progarmme or create problem by his/her misstate or miss action or somehow preventing and stimulating an Afghan citizen from giving correct information shall be followed by justice investigations according to the law orders .
Identification Card
Article Fifteen:
Central Statistics Office will issue identification Cards to All persons who are assigned for the conduct of the population Census. Use of these Cards shall, however be permitted only during the enumeration period.
Guidelines and Manuals
Article Sixteen :
Central Statistics Office will prepare manual/manuals containing guidelines and instructions in order to instruct the personnel engaged to the population census programme .
Initiate Date
Article Seventeen:
This act is validate form its approval date and will publish in the official gazette . by Penetrance of this act , the population census act published on gazette No (408) dated 15/07/1357 is canceled .
